The first, and most important, is that the abuse needs to have been reported to the police. With personal injury claims there are also time limits involved. The claim must be made within three years from the date of the abuse.

However, the court has the discretion to waive this limit in cases of historic abuse. In recent years, there have been a number of historic abuse cases, dating back decades, that have been pursued with success for the claimant.

Criminal Injuries Compensation Authority

We live in age where criminal violence is, unfortunately, an all too common occurrence in parts of our society.

The majority of claims are made through the Criminal Injuries Compensation Authority (CICA) scheme. This is the Government agency that deals with compensation claims for people who have been physically or mentally injured because they were the blameless victim of a violent crime in England Scotland or Wales.

To qualify for compensation through CICA, there are number of criteria you have to satisfy. These include:

• The Applicant has been physically or mentally injured as a result of a crime of violence during the last two years

• The crime happened in England, Scotland or Wales

• The Applicant was a resident in the UK on the date of the violent crime

• The violent crime was reported to the police as soon as reasonable practicable

• The applicant has cooperated with the police in bringing the assailant to justice

• The applicant did not provoke the attack in any way

• The applicant does not have any unspent convictions

Compensation can be awarded for both physical and mental injury and the injuries must be serious enough to qualify for at least the minimum award that is payable under the scheme, this is currently set at £1,000. Compensation will not be awarded for what the CICA deem to be less serious injuries, such as a broken nose, black eyes or broken ribs.

Please note that all applications must be submitted no later than two years from the date of the crime of violence.
