Compensation for cycling accidents

Cycling Accident Solicitors

The growing popularity of cycling in the UK over the past decade has led to an increase in the number of cyclists on our roads.

There were 94 cyclist deaths on our roads in 2018 and a further 15,131 adult cyclist casualties according to the Royal Society for the Prevention of Accidents RoSPA. The majority of these deaths and serious injuries come as a result of an impact with a motor vehicle.

Drivers have a duty of care towards cyclists just as they do with pedestrians. The onus is on the drivers of motor vehicles to be mindful of cyclists, to give them space and respect the fact that they have as much right to be on the road as motor vehicle users.

Cyclists, too, should take every possible measure to ensure they are as visible as they can be: many collisions are caused by drivers’ simply failing to spot a cyclist. This means wearing bright, reflective clothing, using bright lights, and wearing a helmet.

While wearing a helmet is not mandatory, failing to do so could be deemed as contributory negligence if you sustain a head injury, which could in turn drastically reduce the level of compensation received.

What are the most common causes of cycling accidents?

There are many causes of cycling accidents which our experienced solicitors deal with on a regular basis., some of these include:

  • Car door collisions
  • Potholes and road defects
  • Road traffic collisions

Can cyclists claim compensation for a cycling accident?

As a cyclist, if you have been injured in an accident with a road vehicle, you may be entitled to claim for compensation. Browell Smith & Co has many years’ experience of securing justice and compensation for cyclists who have been injured through no fault of their own.

We always recommend speaking to a solicitor as soon as possible after an injury has been sustained as successful physical rehabilitation can depend on rapid action.

Why should I claim compensation?

The aim of any compensation claim is to restore the victim to the condition they were in prior to the accident. This usually comprises the necessary physiotherapy treatment to help recover from injuries, financial compensation for any losses they have incurred as a result of the accident, and also treatment for any psychological damage they may have suffered.
