The Danger of Dogs

As this recent article on the BBC Newcastle website testifies thousands of people are injured each year, in the United Kingdom, as a consequence of dog attacks, the results of which can be life changing.

If you have been injured by an animal it is possible that the owner or keeper of the animal may be held legally responsible for injuries, in which case you may have valid claim for damages or compensation.

Injuries may be caused by domestic pets, horses, cattle etc but the most likely source of an animal attack is that caused by a dog bite.

Compensation following a dog attack is not automatic and in fact frequently difficult to obtain.

Attacks of this nature are often due to the owner, or keepers, failure to keep control of the dog in a public place. Recent changes to the Dangerous Dogs Act 1991 provides for greater protection to the injured party, meaning owners can be prosecuted for attacks which occur in private premises.

This increases the liability of the owner or keeper if a dog is dangerously out of control and this would strengthen any case for compensation.

For attacks carried out by breeds which are not regarded as dangerous the Animal Act 1971 can still apply in order to recover compensation. This Act sets out the criteria upon which any claim for compensation can be pursued.

Much will depend upon the owner having the appropriate pet insurance or household insurance in place by which to compensate the injured party.

This area of law is particularly complex and specialist legal advice is a must for dog attack victims.
