The Office of the Public Guardian is the administrative section of the Court of Protection. Their main objective is to protect the social and financial wellbeing of people with mental incapacity.

If there is no Power of Attorney in existence then family members / carers must make an application to the Court of Protection to be appointed as a Receiver. Our specialist team can assist in this complex area.

Should an Lasting Power of Attorney be in existence then once the person granting the power has lost mental capacity to manage their own affairs, this Power must be registered with the Court of Protection to be validated. If a Lasting Power of Attorney has been granted then this document must be registered with the Court of Protection in all circumstances prior to use.
