Case 2
| Amount Won | £25,000 |
The Claimant, a 65 year old man, pursued a claim through Browell Smith and Co for asbestos induced bilateral pleural thickening and pleural plaques. The claim was against one Defendant who had employed him from 1953 to 1997 and who during that time had exposed him to asbestos dust and fibres.
The nature of the exposure to asbestos was on a daily basis up until approximately 1985. No masks were provided until the late 1980s and the Claimant was never warned as to the risks of asbestos exposure or what to look for. Liability was initially denied but subsequently admitted subject to partly blaming the Claimant. The Defendant alleged that the Claimant had been contributory negligent in that when he was employed in their company in the capacity of a site agent and therefore he would have been responsible for health and safety issues. This was not accepted and the claim was pursued with 100% liability against the employer which was successful.
The matter proceeded towards Trial and just shortly before Trial the claim was settled in the sum of £25,000.00. Settlement was on a full and final basis.
